The architect of the Gunpowder Plot was Robert Catesby, "a gentleman of family and fortune". He had been a supporter of the Earl of Essex who had promised liberty of conscience. This promise was broken and the incensed Catesby adopted the "bloody and unscrupulous project of blowing up the King, Lords, and Commons at one blow". Others who embraced his scheme included Guy Fawkes, Thomas Winter and Francis Tresham.

Typical of the treatment that Catholics were receiving at that time was the story of a Mr Pound, an elderly Catholic gentleman from Cheshire who complained to James on behalf of his co-religionists that they were being unfairly treated. James's response was to have Pound taken to Fleet Prison where he was nailed by his ears to the pillory and fined a thousand pounds. As Catholic priests were being hunted down, fines were multiplying daily against those that had any connection with them. It was known that "the sword of the law was about to receive a keener edge in the next parliament".
